Soal Ekstradisi, Mahfud MD Mengaku Keliru

VIVAnews – Ketua Mahkamah Konstitusi Mahfud MD pekan lalu mendesak pemerintah untuk menyusun perjanjian ekstradisi dengan Singapura, terkait banyaknya orang-orang berpekara hukum di Indonesia yang menyembunyikan diri ke Singapura.


Belakangan, pernyataannya itu dia akui keliru karena perjajian ekstradisi sudah ditandatangani kedua negara, namun belum diratifikasi DPR.


Kedutaan Besar Singapura di Jakarta akhir pekan lalu sempat "meluruskan" pernyataan Mahfud. Menurut pihak Kedubes, perjanjian ekstradisi antara Indonesia dan Singapura telah ditandatangani kedua pemerintah pada tahun 2007.

“Penandatanganan perjanjian tersebut juga disaksikan oleh Presiden Susilo Bambang Yudhoyono dan Perdana Menteri Singapura Lee Hsien Loong di Bali pada 27 April 2007,” kata Sekretaris Pertama Bidang Politik Kedutaan Besar Singapura di Indonesia, Herman Loh, dalam keterangan tertulis yang diterima VIVAnews, Sabtu malam, 4 Juni 2011.


Mahfud pun akhirnya mengakui, perjanjian ekstradisi antara Indonesia dan Singapura yang telah ditandatangani itu, di luar pengamatannya. Itulah sebabnya dia sempat memberi pernyataan yang kurang tepat.


“Ada yang terlewat dalam pengamatan saya. Pekan lalu, saya minta diadakan perjanjian ekstradisi Indonesia-Singapura. Tapi ternyata perjanjian itu sudah ada,” ujar Mahfud usai mengisi kuliah umum tentang Pancasila di Fakultas Hukum Universitas Islam Indonesia, Yogyakarta, Senin 6 Juni 2011.


Kini, Mahfud pun meminta pemerintah untuk meratifikasi perjanjian ekstradisi tersebut, karena perjanjian itu tidak akan berlaku kalau belum diratifikasi. Padahal, kata Mahfud, bila tidak diratifikasi, maka hal itu akan menjadi celah bagi koruptor di Indonesia untuk mengamankan diri di Singapura.


Sebelumnya, Juru Bicara Kementerian Luar Negeri RI Michael Tene memaparkan, ada perbedaan posisi antara Indonesia dan Singapura dalam memandang perjanjian ekstradisi. Singapura menginginkan perjanjian ekstradisi sepaket dengan kerja sama pertahanan atau Defence Cooperation Agreement (DCA), sedangkan Indonesia ingin agar kedua perjanjian itu berdiri sendiri-sendiri.


“Singapura mengaitkan kedua perjanjian itu, sementara Indonesia tidak. Indonesia ingin perjanjian ekstradisi diratifikasi tanpa harus menunggu ratifikasi kerja sama pertahanan,” jelas Tene. Posisi indonesia saat ini adalah, bersedia meratifikasi perjanjian ekstradisi, namun tidak bersedia meratifikasi kerja sama pertahanan yang dinilai masih menyimpan masalah dalam sejumlah pasalnya.


Pasal bermasalah tersebut adalah soal diperbolehkannya Singapura melakukan latihan militer di wilayah Indonesia, termasuk bila mereka menggelar latihan perang dengan negara lain.
